01Introduction and acceptance
These terms govern your use of the Halo HSE mobile application (the "App") published by MB The Special Something, a Lithuanian mažoji bendrija registered at Perkūnkiemio g. 13-91, LT-12114 Vilnius, Lithuania. Company registration: 304485059. VAT: LT100012830516 ("we", "us", "our").
By downloading, installing, or using the App, you agree to these terms. If you do not agree, do not use the App.
02The App and how it works
Halo HSE is an iOS application providing calculators, reference content, PDF export, and iCloud sync for Health, Safety, and Environment (HSE) professionals. Some features (see the Pricing section on halosafety.io) require a one-time in-app purchase called Halo HSE Pro.
The App works offline. iCloud sync requires an active Apple ID and a network connection at the moment of sync; it is not required for the App to function.
03Merchant of record
Apple Inc. is the merchant of record for all in-app purchases in the App. Users purchasing Halo HSE Pro are entering into a transaction with Apple under Apple's Media Services Terms and Conditions.
Refunds are handled by Apple through the App Store, not by MB The Special Something. If you have trouble requesting a refund, contact hello@halosafety.io and we will assist where we can, but the refund decision rests with Apple.
MB The Special Something receives a license fee from Apple and, in turn, grants users a license to use the Pro features of the App under these terms.
04License grant
Subject to your compliance with these terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on iOS devices signed in to your Apple ID.
The license does not permit you to: reverse-engineer, decompile, or disassemble the App; redistribute or resell the App; remove or alter any copyright or trademark notices; or use the App to build a competing product.
All intellectual property in the App, its content (including reference summaries, calculator formulas as implemented in code, brand assets, and PDF templates), and the Halo, Halo Safety, and Halo HSE names and marks belongs to MB The Special Something.
05Reference content disclaimer
The App includes reference content: GHS pictograms and H/P statements, EU directive summaries, and toolbox talks. This content is provided as-is for professional reference.
The reference content does not replace consultation of official sources or the exercise of professional judgment. You are responsible for verifying against authoritative sources (Regulation (EC) No 1272/2008, the specific directive text, your Competent Authority, etc.) before making compliance decisions.
MB The Special Something makes reasonable efforts to keep this content current but does not warrant its accuracy, completeness, or fitness for any particular compliance purpose.
06Calculator results disclaimer
The App's calculators implement standard formulas from published HSE regulations and standards, including — but not limited to — EU Directive 2003/10/EC (noise), OSHA 1910.95 (noise), EU Directive 2002/44/EC (hand-arm vibration), the NIOSH Revised Lifting Equation (1994), and ISO 31000 (risk).
Calculator outputs depend entirely on the accuracy of user-provided inputs (measurements, durations, weights, distances, thresholds). Results should be verified and used in conjunction with your professional judgment.
The App is not a substitute for professional HSE consultancy, calibrated instrumentation, or legal advice. Decisions with regulatory, contractual, or safety implications must be made by a qualified person exercising independent judgment.
07User conduct
You may not use the App for any unlawful purpose or in any way that could damage, disable, or impair the App or interfere with any other party's use of it.
You may not attempt to circumvent the Halo HSE Pro purchase mechanism (including jailbreak-based unlocks, receipt tampering, or resale of purchase credentials).
08Limitations of liability
To the extent permitted by Lithuanian law and applicable EU consumer protection law, MB The Special Something's total liability arising from or in connection with the App is limited to the amount you paid for Halo HSE Pro (or, if you have not purchased Pro, zero).
Nothing in these terms limits liability for gross negligence, intentional harm, or personal injury caused by us, in line with Lithuanian Civil Code Article 6.252. Nothing in these terms limits any statutory rights you have as a consumer under mandatory EU or Lithuanian law.
The App is provided "as is" and "as available" without warranty of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in these terms or required by law.
09Changes to the terms
We may update these terms from time to time to reflect changes in the App, in applicable law, or in our business practices. The version number and effective date at the top of this document indicate the current version.
Material changes will be notified via the App or, if you have provided your email address (for example, when generating an expense receipt), via email. Continued use of the App after changes take effect constitutes acceptance of the updated terms.
10Termination
You may stop using the App at any time by deleting it from your devices.
We may suspend or terminate your access to the App if you materially breach these terms. Termination does not entitle you to a refund of any Pro purchase, which is governed by Apple's refund process.
11Governing law and jurisdiction
These terms are governed by the laws of the Republic of Lithuania.
Any dispute arising from or in connection with these terms is subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania — subject to any mandatory EU consumer protection provisions that grant you, as a consumer, the right to bring proceedings in the courts of your country of residence.
